Asbestos claims: Statutes of limitation

No matter what kind of injury-related lawsuit or claim you hope to pursue in the state of Pennsylvania, you will only have a limited amount of time in which to file your claim. This time limitation is referred to as the statute of limitation. With a mesothelioma claim, one might wonder -- since this condition can develop as many as 10 to 40 years following asbestos exposure -- how long are the statutes of limitation?

Every state has a different statute of limitation that applies to mesothelioma lawsuits. In Pennsylvania, that statute of limitation begins to toll as soon as the patient receives his or her first mesothelioma diagnosis and/or when the patient discovered that he or she has mesothelioma. Although some states offer patients up to five years to file a claim, in Pennsylvania, patients only have two years from the date of discovery.

Statutes of limitation are also two years in cases where an individual passed away as a result of mesothelioma. In these situations, close family members can try to pursue wrongful death damages and other compensation related to their loved one's death.
