Could asbestos finally be banned in the U.S.?

Asbestos is an extremely dangerous chemical, responsible for over 107,000 deaths and over 1,523,000 disabilities every year. The U.S. made a big step in the right direction in 2016 to regulate this dangerous chemical. Congress passed the Frank R. Lautenberg Chemical Safety for the 21st Century Act into law earlier this year. The act empowers the Environmental Protection Agency (EPA) to ban the use of asbestos in the U.S.

Who are the responsible parties in a product liability suit?

When a plaintiff is injured by a defective or dangerous product, one of the first orders of business to be carried out by his or her personal injury attorney is to determine who the responsible and liable parties are. In determining who these parties are, the lawyer must look to the contractual relationships that came into being when the defective or dangerous product was sold in the marketplace.

In ancient times, it was easier to know how safe an object or tool was, and they were easy to inspect for dangers. Like a shovel, for instance, with a weak handle, might break in the middle of use. Users of tools, domestic products like cups and plates, and other human-made items during antiquity could easily assess whether something was dangerous to use. Conversely, in the modern world it could take a veritable Sherlock Holmes to figure out if something was dangerous.
