Drunk driving accident results in bodily injury in Preston County

An all-terrain vehicle crash left victims with injuries following an incident that happened on a recent Saturday in Preston County. According to the county sheriff's department, the crash happened in Albright on Aug. 12.

A 49-year-old man from Garret was operating the ATV in the accident. A female passenger who was riding with the man on the ATV required a helicopter flight to Ruby Memorial Hospital after suffering serious injuries. At this time, the extent and details pertaining to the injuries remain unknown.

When sheriff's deputies arrived at the crash scene, they found the 49-year-old ATV driver to have glassy and bloodshot eyes. They also said the man's speech was slurred and he was unsteady on his feet. Officers conducted a field sobriety test on the man, which he failed. They also administered a breath test, which showed his blood alcohol concentration (BAC) to be .132 percent.

Based on their observations, deputies arrested the man on drunk driving charges. A second alcohol breath test was administered at the Preston County Sheriff's Office, where the man blew a .088 percent BAC, which was still above the legal limit. Not long after being booked, the man secured his release by posting $2,500 bond.

When a drunk driving accident results in serious bodily harm to a passenger, the injured individual may wish to pursue a personal injury claim for financial damages relating to the costs of his or her medical care. Other damages could be pursued in such a case as well, including money for lost income, pain and suffering, attorneys' fees, punitive damages and more.
